dc.description	The interest in clarifying the facts and the interest to protect fundamentalrights are, according to the prevailing doctrine, incompatible claims in thearea of criminal procedure. However, the necessary contrast is the result ofinadequate analysis as to how both interests relate. Indeed, while the indemnityof certain fundamental rights may interfere with determination of facts,the indemnity of others may encourage criminal procedural decision bestsuited to the way it really happened.	en-US
dc.description	El interés en esclarecer los hechos y el interés por tutelar los derechos fundamentalesconstituyen, de acuerdo con la doctrina prevaleciente, pretensionesincompatibles en el ámbito procesal penal. Sin embargo, esa contraposiciónnecesaria es resultado de un inadecuado análisis respecto del modo en quese relacionan ambos intereses. En efecto, mientras la indemnidad de algunosderechos fundamentales puede perjudicar el esclarecimiento de los hechos,la indemnidad de otros puede favorecer una decisión procesal penal másajustada al modo en que realmente ocurrieron los hechos.	es-ES
