| dc.description | This article will analyze the incident of rescission (or nullity) of proceedings due to the lack of summon from article 80 of the Code of Civil Procedure, especially regarding its grounds and consequences. It will be characterized as a means to leave without effect proceedings in which there has not been an effective summon, even in cases where there has been no defect, that can be exercised by any person who was or should have been claimant in the process, including after said process has finished. | en-US |
| dc.description | El presente artículo analizará el incidente de rescisión (o nulidad) de lo obrado por falta de emplazamiento del art. 80 del Código de Procedimiento Civil, en especial en lo referente a sus presupuestos de procedencia y consecuencias. Se le caracterizará como un medio para dejar sin efecto juicios en los que no ha habido un efectivo emplazamiento, incluso en casos en los que no ha existido vicio alguno, que puede ser ejercido por cualquier persona que fue o ha debido serparte en el proceso, aun cuando este ya se encuentre terminado. | es-ES |
