| dc.description | This work analyzes the way in which indigenous lands are treated inlegislation and its critical role in the state’s regulatory scheme towards indigenous peoples. The article scrutinizes the paradigm according to which land constitute the main pillar of indigenous identity, as well as the regulatory and policy implications of the state’s duties of protection and restitution of indigenous lands that result from said paradigm. The article argues that even though land does have a fundamental role in indigenous identity, regulations and policies that focus almost exclusively on land must be carefully examined, as there are other elements critical to the preservation of indigenous identities, such as language. | en-US |
| dc.description | Este trabajo analiza la forma en que se encuentran tratadas las tierras indígenas en la legislación chilena y el rol crítico que tienen aquéllas en el edificio regulatorio del derecho estatal hacia los pueblos indígenas. Se somete a escrutinio el paradigma según el cual la tierra es el fundamento principal de la identidad indígena y se analizan las implicancias tanto jurídicas como de política pública de los deberes de protección y ampliación de las tierras indígenas que son consecuencia de dicho paradigma. Se postula que, si bien la tierra tiene efectivamente un rol fundamental en la identidad indígena, deben examinarse cuidadosamente las regulaciones y políticas que se centran casi exclusivamente en la tierra, en desmedro de otros elementos clave para la preservación de dicha identidad, como la lengua. | es-ES |
