| dc.description | This article will analyze if whether the right to refuse medical treatment, recognized in the legislative statute Nº 20.854, can be considered as an acknowledgement of the right to take life itself. For that, the article addresses thesis of the free availability of the life, to then analyze its objections. It also addresses the compatibility or incompatibility of that thesis with the Chilean legal system. After defining the scope of the right to life and the juridical value of life itself, the article evaluates the relevant provisions of the law Nº 20.854 to delimit its true scope. | en-US |
| dc.description | En este artículo analizaremos si el derecho a rechazar tratamientos, consagrado en la Ley Nº 20.854, puede considerarse como un reconocimiento del derecho a disponer de la propia vida. Para ello comentaremos en qué consiste la tesis de la disponibilidad de la vida, para luego analizar las objeciones que se le formulan, así como su compatibilidad o incompatibilidad con nuestro sistema jurídico. Luego de delimitar el alcance que tiene el derecho a la vida y el valor que jurídicamente se le asigna a la vida misma, podremos enjuiciar las disposiciones pertinentes de la Ley Nº 20.854 para delimitar su verdadero alcance. | es-ES |
