| dc.description | The author proposes to undertake an analysis of the regulatory processes of the introduction of the net neutrality principle in Chile and the United States in order to establish some basic principles about the role of the legislature and the administrative agency in the regulation of technologies, starting from real experience. The analysis leads to the conclusion that the legislature, being the main institution designed to encompass and concretize the political debate (and, therefore, different normative or moral positions) onto mandatory rules, must have its place in the regulation of technologies. But in the same way, the examination indicates that the extent of congressional action should be determined precisely by its main role of being the forum comprising political divergence or debate, avoiding, if possible, to dwell into complex technical issues. | en-US |
| dc.description | Se propone analizar los procesos regulatorios de introducción del principio de neutralidad de la red en Chile y Estados Unidos con el fin de, partiendo de una experiencia real, sentar algunos principios base respecto del rol del legislador y el órgano administrativo en la regulación de tecnologías. El análisis realizado lleva a concluir que el Poder Legislativo, al ser la principal institución diseñada para abarcar y concretizar el debate político (y, por tanto, las diversas posturas normativas o valóricas) en normas obligatorias, debe tener su lugar en la regulación de tecnologías. Pero de la misma forma, el examen efectuado indica que la extensión de la acción del Congreso debería estar determinada, justamente, por su rol principal de ser el foro que comprende el debate o la divergencia política, evitando, en lo posible, introducirse de lleno en complejos aspectos técnicos. | es-ES |
