| dc.description | In English law HRA is significantly important because of both its enactment and its practical application. By its enactment, the HRA gave effect in English domestic law to a number of rights enshrined in the European Convention on Human Rights 1950. Furthermore, its practical application has had a fundamental impact on the structure and working of the English legal system. This article’s goal is to consider the latter point of view. To this end, one of the most important decisions on this issue is analysed: the United Kingdom Supreme Court’s decision in Smith and others v. The Ministry of Defence. | en-US |
| dc.description | En el derecho inglés la HRA tiene una significativa importancia tanto por el hecho de su dictación como por su aplicación práctica. En virtud de su dictación, la HRA incorporó al derecho interno inglés un conjunto de derechos consagrados en la Convención Europea de Derechos Humanos de 1950. Además, su aplicación práctica ha tenido un impacto fundamental en la estructura y funcionamiento del sistema legal inglés. El objetivo de este trabajo es considerar la relevancia de la HRA desde este segundo punto de vista. Para ello se analiza una de las decisiones más importantes sobre esta materia: la sentencia de la Corte Suprema del Reino Unido pronunciada en la causa Smith and others v.
