| dc.description | This work seeks to show the test performed by the Chilean Supreme Court when it granted the claims presented to it via the constitutional habeas corpus remedy, reverting decisions that would not grant the parole benefit. There are several legal and factual grounds that the Supreme Court has considered to grant this parole decisions, which confirms the operational and active nature of the habeas corpus. | en-US |
| dc.description | La presente investigación expone el examen que hace la Corte Suprema al conocer, por la vía del recurso de amparo constitucional, de los casos de negativa de otorgamiento de libertad condicional; al acoger dichas acciones constitucionales y al ordenar diversas medidas, tales como: revisar antecedentes nuevamente, materializar el otorgamiento de la libertad condicional al interesado o, en fin, otorgar dicha libertad. Hay diversos fundamentos de carácter legal y fácticos que ha tenido a la vista el supremo tribunal para acoger las pretensiones formuladas por la acción constitucional en comento, lo que ratifica la vigencia y operatividad de esta. | es-ES |
