| dc.description | This research inquired into the legal nature of the rules contained in articles 45 and 46 of the Transparency Act to illuminate the wrong application of the second as if it were an administrative penalty. Thus, it is held that, in the context of the execution of a firm decision that mandates the surrender of public information and in the presence of persistence by the non-compliant organism or authority, it should be understood that a compulsion must be applied and that it’s not possible to the principles of Administrative Law Penalties in doing so. | en-US |
| dc.description | Esta investigación indaga acerca de la naturaleza jurídica del contenido de los artículos 45 y 46 de la Ley de Transparencia, con el objetivo de iluminar la errada aplicación de la segunda de estas normas como si se tratara de una sanción administrativa. En efecto, se sostiene que en el marco de la ejecución de resoluciones a firme que ordenen la entrega de información pública, ante la persistencia del órgano o autoridad incumplidora, lo que realmente corresponde es aplicar un apremio, quedando descartada la utilización de los principios del Derecho Administrativo Sancionador. | es-ES |
