| dc.description | This paper critically examines one of the key factors to judicial activism, namely, the legal character of the Constitution. Throughout a comparative analysis, the author puts under question the premise that all constitutional provisions are judicially enforceable by its own nature. Specifically, this work looks carefully into the legal status of social rights and argues from different perspectives that Congress and not the Judiciary has the primacy on the configuration of such positive rights. Consequently, judges are bounded by statutory law when it comes to decide what the scope of social right is. | en-US |
| dc.description | En este artículo se examina críticamente uno de los factores que estaría explicando el activismo judicial, a saber, la fuerza normativa de la Constitución. A través de un análisis comparativo, se cuestiona la premisa de que todas las normas de una Constitución, por el mero hecho de serlas, pueden aplicarse directamente por los tribunales de justicia. Específicamente, el estudio se detiene en el estatuto normativo constitucional de los derechos sociales, y ofrece argumentos dogmáticos y comparados para afirmar la primacía del legislador en la configuración de estos derechos prestacionales y el deber que los jueces tienen de observar la ley. | es-ES |
