| dc.description | Since 1979, the Peruvian Constitutional Law has a double system to control legislation. First of all, any judge can declare the unconstitutionality about any norm against the constitution supremacy, and, the second way, with a separate and independent Constitutional Court, can leave without effects any norm or treaty against it. Both systems make possible the judicial review, with no crossings because the last decision is from the Constitutional Court. This paper wants to explore the origin of this special kind of constitutional control in the region. | en-US |
| dc.description | Desde 1979, el derecho constitucional peruano cuenta con un doble sistema de control de las leyes. En primer lugar, cualquier juez puede declarar la inconstitucionalidad sobre cualquier ley que contradiga la supremacía constitucional. La segunda vía es por medio de un tribunal constitucional especializado e independiente, que puede dejar sin efectos cualquier ley o tratado internacional. Ambos sistemas hacen posible la revisión judicial de las leyes sin cruzarse porque la última decisión corresponde al Tribunal Constitucional. El presente trabajo explora el origen de este singular tipo de control de constitucionalidad en la región. | es-ES |
