Si bien las primeras normas sobre seguridad y salud en el trabajo surgieron en el siglo XIX, esta área del derecho laboral siguió desarrollándose según la voluntad política de cada país. El alcance de la protección de la salud y seguridad en el trabajo se ha ampliado gracias a la ratificación de los Convenios de la Organización Internacional del Trabajo (OIT), así como al cumplimiento del Pacto Internacional de Derechos Económicos, Sociales y Culturales (PIDESC) y del Protocolo Adicional a la Convención Americana sobre Derechos Económicos, Sociales y Culturales (Protocolo de San Salvador). El objetivo del presente estudio es analizar los tratados internacionales y el marco jurídico regional en relación con la protección internacional del derecho humano a la seguridad y salud en el trabajo, mientras se explica la jurisprudencia regional relevante a efectos de definir el contenido mínimo de este derecho humano fundamental.Although the first regulations on workplace safety and health emerged in the 19th century, this area of Labor Law has continued to develop according to the political commitment of each country. The scope of protection of occupational safety and health has been extended with the ratification of the Conventions of the International Labor Organization (ILO), as well as the compliance with the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (Protocol of San Salvador). The purpose of this paper is to analyze the international treaties and the regional legal framework related to the international protection of the human right to safe and healthy work, while explaining the relevant regional jurisprudence, in order to define the minimal content of this fundamental human right.
