| dc.description | El propósito del artículo es entregar información y reflexiones a fin de contribuir al estudio de los sesgos cognitivos y otros factores externos como elementos subyacentes a la toma de decisiones de los diferentes actores del sistema de justicia criminal. Para ello, el artículo presenta una revisión integral de un fenómeno transversal a todas las etapas y actores del proceso penal denominado visión de túnel. La primera parte de este trabajo presenta algunas nociones elementales del fenómeno, explicitando la manera en que se produce y dando cuenta de los diferentes sesgos cognitivos involucrados en el proceso. Luego, se presentan otras fuerzas externas que contribuyen y exacerban el fenómeno. La tercera parte, aborda la relación de la visión de túnel con los factores clásicos de errores en el sistema de justicia criminal. Por último, se presentan algunas estrategias para sobreponerse o mitigar los efectos perniciosos del fenómeno. | es-ES |
| dc.description | This paper seeks to provide information and thoughts in order to contribute to the study of cognitive biases and other external factors as underlying conditions in the decision-making of the different actors of the criminal justice system. Thus, this paper presents a comprehensive review of tunnel vision as a complex phenomenon that cuts across all stages of the criminal procedure and impacts decision-making. The first part provides an overview of the concept of tunnel vision, explaining the manner in which it is produced, stating the main cognitive biases involved. Then, other external factors that contribute to creating or exacerbating tunnel vision are presented. The third part addresses the relationship of tunnel vision and miscarriages of justice under the so-called classic factors. Finally, some strategies to overcome or mitigate the phenomenon’s effects are presented. | en-US |
