| dc.description | El presente trabajo tiene como objeto de estudio la nueva Ley 21.208, conocida como "ley antisaqueos”, publicada en enero del 2020, la cual modifica el Código Penal en materia de delitos contra el orden y la seguridad pública, así como de ciertos delitos contra la propiedad. En particular, incorpora un agravamiento para algunas penas asociadas a ilícitos que en la practica suelen cometerse con ocasión de manifestaciones sociales. Las razones para comentar este cuerpo normativo se inscriben en el contexto del cual surge (“estallido social”) y en las repercusiones que su aplicación pudiera tener en lo que respecta al ejercicio legítimo y democrático del derecho a la protesta social. Este último aspecto, a la luz del reconocimiento que internacionalmente se le ha brindado a este derecho en materia de derechos humanos. De esta manera, nos interesa observar en qué medida esta ley conlleva un efecto criminalizador para el ejercicio del derecho a la protesta social. | es-ES |
| dc.description | The purpose of this work is to study the Law 21,208, known as the «antilooting law», published in January 2020, which amends the Penal Code regarding crimes against public order and security and certain crimes against property. In particular, it incorporates an aggravation for some penalties associated with offenses that in practice are usually committed on the occasion of social demonstrations. The reasons for commenting on this body of law lie in the context in which it arises (“social outburst”) and in the repercussions that its application could have on the legitimate and democratic exercise of the right to social protest. This last aspect, regarding the international recognition given to this right in terms of human rights. Thus, we are interested in observing to what extent this law may have a criminalizing effect on the exercise of the right to social protest. | en-US |
