Este trabajo examina el supuesto fáctico en el que un peatón, intentado evitar el atropello por un vehículo autónomo, da muerte al pasajero a bordo con el objeto de resguardar su integridad física. Lo anterior se abordará desde la perspectiva del estado de necesidad y el doble efecto, ahondando en los criterios axiológicos de valoración en torno a la occisión directa, así como el sustrato normativo involucrado y su relación con la figura del dolo penal.This work examines the factual supposition in which a pedestrian, trying to avoid being run over by an autonomous vehicle, kills the passenger on board in order to protect his physical integrity. The above will be addressed from the perspective of the state of necessity and the double effect, digging into the axiological assessment criteria regarding a direct killing, as well as the normative substrate involved and its relationship with the figure of criminal intent or malice.
