The paper discusses the legal situation of the indigenous groups of northern Chile (particularly the Ayrnarás and Atacameños) and the legislation currently applicable to them. It points out that the current Indigenous Law No. 17,729 of 1972 is only applicable to the Mapuches of southern Chile, and not to the other indigenous groups. Since there is no special law that contradicts their previous legal situation during colonial times, and the Republic of Chile has recognized the Spanish law codified in the "Recopilación de las Leyes de Indias" (1680), which accepted custom as a source of law, it is concluded that the indigenous groups mentioned above are, to this day, governed by their customary law, established by their uses and customs.El trabajo discute la situación jurídica de los grupos indígenas del Norte de Chile (particularmente ayrnarás y atacameños) y la legislación que les es aplicable en la actualidad. Señala que la actual Ley de Indígenas N° 17.729, del año 1972, sólo es aplicable a los mapuches del sur de Chile, y no a los restantes grupos indígenas. No existiendo ley alguna de carácter especial que contradiga su situación jurídica anterior, durante la Colonia, y habiendo reconocido la República de Chile el Derecho español codificado en la "Recopilación de las Leyes de Indias" (1680). el que aceptaba la costumbre como fuente de derecho, se concluye que los grupos indígenas citados, hasta el día de hoy, están regidos por su derecho consuetudinario, establecido por sus usos y costumbres.
