dc.descriptionThis paper aims to provide an approximate analysis of the dogmatic foundations of crimes against public health, and the problems that have raised the interpretation of the crime contained in Article 318 of the Chilean Penal Code. In the current pandemic situation, public health has become a focus of attention, both at the legislative and judicial level. Therefore, this article will succinctly develop the basis for understanding public health as a protected legal good, as well as the dogmatic discussion around the binomial of abstract / concrete danger that would characterize the criminal type. Finally, an alternative model of interpretation will be proposed.en-US
dc.descriptionEste trabajo pretende aportar un análisis aproximativo a los fundamentos dogmáticos de los delitos contra la salud pública y a la problemática que ha suscitado la interpretación del delito contenido en el artículo 318 del Código Penal chileno. En pandemia, la salud pública se ha convertido en un foco de atención, tanto en el plano legislativo como judicial. Por esto, en este artículo se desarrollarán sucintamente las bases de comprensión de la salud pública como bien jurídico protegido, así como la discusión dogmática en torno al binomio de peligro abstracto/concreto que caracterizaría al tipo penal para, finalmente, proponer un modelo alternativo de interpretación.es-ES
