| dc.description | El clásico dilema de la jerarquía de los tratados internacionales dentro del ordenamiento jurídico chileno, dejando las argumentaciones basadas en lo semántico y en la literalidad de los textos, para abordar el asunto desde una perspectiva moderna enfocada en los problemas que pueden provocar las reformas constitucionales “tácitas”. Para esto estudiamos la teoría del bloque de constitucionalidad en el derecho comparado, con una especial mención al fenómeno del derecho de la Unión Europea, de manera que sea la experiencia quien nos ayude a resolver esta controversia. | es-ES |
| dc.description | The classic dilemma of the hierarchy of international treaties within the Chilean legal system is analyzed, leaving the arguments based on the semantic and literalness of the texts, now addressing the matter from a modern perspective focused on the problems caused by the “tacit” constitutional amendments. The theory of the constitutional block in comparative law is studied, with a special mention to the phenomenon of European Union law, so that experience helps us to resolve this controversy. | en-US |
