Lejos del papel que corresponde a un tribunal de justicia, en esta sentencia se advierte un verdadero acto legislativo, por cuanto se redefine el concepto de ‘ciudadanía’ consagrado en la Constitución, trastocando con ello parte de la legislación. El propósito de este comentario es proyectar las consecuencias de esta decisión, y mostrar cómo esta sentencia representa una intromisión de los jueces en un asunto de naturaleza política. | es-ES |
| dc.description | The sentence Casilla with Junji, issued by the Supreme Court, is an act of what we can call "judicialization of politics". Far from the role that corresponds to a court of justice, this ruling is a true legislative act, as it redefines the concept of "citizenship" enshrined in the Constitution, thus altering part of the legislation. The purpose of this commentary is to project the consequences of this decision, and to show how this sentence represents an intrusion of the judges in a matter of political nature. | en-US |
