| dc.description | This work exposes the meaning and scope of the requirement of “lack of sufficient provocation” required by article 10 N ° 4 of the Penal Codeto recognize the cause of justification of Self-Defense. For this, we will start by analyzing the concept of provocation, its requirements, historicalorigins, and the different theories that criminal dogmatics have formulated about when it should be understood that it is enough. Then the differenttypes of provocation will be indicated in their subjective aspect. | en-US |
| dc.description | El presente trabajo tiene por objetivo exponer sobre el significado y alcance del requisito de “falta de provocación suficiente” exigido por el art. 10 N° 4 del Código Penal para reconocer la causa de justificación de legítima defensa. Para ello, partiremos por analizar el concepto de provocación, sus requisitos, orígenes históricos y las distintas teorías que ha formulado la dogmática penal sobre cuándo debe entenderse que es suficiente. Luego se indicarán los distintos tipos de provocación en su aspecto subjetivo. | es-ES |
