dc.descriptionThe present thesis aims to introduce to the constitutional debate facing the composition of a new Constitution for Chile the figures of Latin American constitutionalism, especially of the new decolonized constitutionalism based on its greatest exponents, the constitutions of Bolivia and Ecuador.In this context, the so-called social outbreak is analyzed, the causes of the current constituent process and the deficiencies of the current Constitution, considering its main reforms in 1989 and 2005. The constituent process in Chile, unprecedented, indeed, will allow the creation of a new Constitution in democracy for all Chileans, which will need all the inputs for the elaboration of a fundamental charter that overcomes the socio-political crisis generated from October 18, 2019 with the popular revolt against the injustices and inequalities of the last decades in the country.en-US
dc.descriptionEl presente trabajo tiene por objeto introducir al debate constitucional de cara a la redacción de una nueva Constitución para Chile las figuras propias del constitucionalismo latinoamericano, especialmente de aquel nuevo constitucionalismo descolonizado a partir de sus máximos exponentes, las constituciones de Bolivia y Ecuador. En este contexto se analiza el denominado estallido social, las causas del proceso constituyente actual y las deficiencias de la actual Constitución, considerando sus principales reformas en 1989 y del 2005. El proceso constituyente en Chile, inédito, por cierto, permitirá la creación de una nueva Constitución en democracia para todos los chilenos, que necesitará de todos los insumos para una elaboración de una Carta fundamental que supere la crisis socio política generada a partir del 18 de octubre de 2019 con la revuelta popular ante las injusticias y desigualdades de las últimas décadas en el país.es-ES
