dc.descriptionBoth in the United States and Puerto Rico, the process of administrative rule- making provide for citizen participation through the submission of written com- ments about proposed regulations. This paper addresses justifications for this type of mechanism from the standpoint of Administrative Law while at the same time it portraits it as an example of citizen participation in public decision-making. The dissatisfaction produced in the way this mechanism operates is also exami- ned and its effectiveness is put into question. In the search for answers the paper recognizes the limits of Administrative Law and its process-oriented focus, and turns instead to recent research in citizen participation. It concludes with a dis- cussion of these issues in the context of new developments in the U.S. where the possibilities of participation in rulemaking have expanded through an electronic platform on the internet.en-US
dc.descriptionEn los Estados Unidos de América y Puerto Rico la adopción de reglamentos administrativos provee entrega una oportunidad para que la ciudadanía participe en dichos procesos a través de la presentación de comentarios escritos en torno a propuestas de reglamentación. El trabajo discute justificaciones para lo anterior desde el punto de vista del Derecho Administrativo y lo trata como una moda- lidad de participación ciudadana en la toma de decisiones de asuntos públicos. Se consideran varias insatisfacciones que produce en su funcionamiento este me- canismo de comentarios escritos hasta llegar al cuestionamiento de si se trata del instrumento más adecuado y eficaz para propiciar y aprovechar esa participación. Ante las limitaciones que presenta la disciplina del Derecho Administrativo para contestar estas preguntas, se incorporan entonces criterios de análisis producto de investigaciones recientes sobre el tema de participación ciudadana. Al final se concluye con una reflexión de estos temas en el contexto de nuevos desarrollos en Estados Unidos donde se ha ampliado el alcance de la participación en procesos de reglamentación a través de una plataforma electrónica en internet.es-ES
