| dc.description | As the legal systems have started to point towards transparency in automated decision-making as a way of protecting the people who may be the subject of said determinations, it has grown the need to analyze how these tools are reconciled with other rights that may be affected by them. This text analyzes business secrecy as a source of opacity, reviewing its operation from the logic of the validity of the principle of good faith in Labor Law, contrasting it with the right to information of the workers’ representatives on the algorithm, takin the spanish Riders Law as example, and looking for evidence that from this perspective, the access to information is allowed as well as the protection of business interests is ensured. | en-US |
| dc.description | En la medida que los ordenamientos comienzan a apuntar a la transparencia en la toma de decisiones automatizadas como forma de protección de las personas que puedan ser objeto de dichas determinaciones, comienza a perfilarse la necesidad de analizar cómo estas herramientas se concilian con otros bienes jurídicos que puedan verse afectados por ellas. En este texto se analiza el secreto empresarial como fuente de opacidad, revisando el vínculo de aquel con la vigencia del principio de buena fe en el Derecho del Trabajo y contrastándolo con el derecho de información de los trabajadores sobre el algoritmo, mirando el ejemplo de la Ley Rider en España, buscando evidenciar que desde dicha perspectiva se permite tanto el acceso a la información como se asegura la protección de los intereses empresariales. | es-ES |
