| dc.description | This article provides a legal analysis of the Chilean Anti-Competitive Market Distortions Office (or “Comisión Antidistorsiones”). This office was established by Law No. 18,525 of 1986, and, after several legal amendments, complies with the international obligations that Chile has undertaken in the Marrakech Agreement of 1994 and four of its annexes, with respect to practices that may have negative effects on international trade, and ultimately, damage to local production and consumers. To this end, the theoretical bases are established on the relationship between International Law and domestic law, with special attention to this specific field of the international legal system, International Economic Law. Then, the multilateral trade system and the rules derived from the World Trade Organization are briefly discussed to contextualize the investigated topic. Finally, we proceed to analyze the composition, effectiveness, and consequences of the Office’s decisions, considering the relevant administrative and procedural rules and their contestation processes, in order to determine the level of compliance that Chile gives to the international rules in this matter. | en-US |
| dc.description | En el presente artículo se realiza un análisis jurídico a la Comisión Nacional Encargada de Investigar la Existencia de Distorsiones en el Precio de Mercaderías Importadas, denominada frecuentemente como “Comisión Antidistorsiones”. Esta Comisión fue establecida mediante la Ley N° 18.525 de 1986, y, tras diversas modificaciones legales, da cumplimiento a las obligaciones internacionales que Chile ha contraído en el Acuerdo de Marrakech de 1994., y cuatro de sus anexos, respecto a prácticas que puedan tener efectos negativos en el comercio internacional, y en último término, perjuicios en la producción y en consumidores locales. Para ello, en primer lugar, se sientan las bases teóricas sobre la relación entre el Derecho Internacional y el derecho interno, con especial atención en esta especifica rama del ordenamiento jurídico internacional, el Derecho Internacional Económico. Luego, se aborda brevemente el sistema multilateral de comercio y las reglas derivadas de la Organización Mundial del Comercio para contextualizar el tópico investigado. Finalmente, se procede a analizar la integración, eficacia y consecuencias de las decisiones de la Comisión, teniendo a la vista para ello la normativa administrativa y procesal atingente y sus procesos impugnatorios, con el fin de dilucidar de manera integral el nivel de cumplimiento que da Chile a la normativa internacional en esta materia. | es-ES |
