Artificial intelligence is one of the greatest technological developments of the 21st century and it has the ability to have a positive, but also negative, impact on human life. In this way, the use of artificial intelligence systems can result in the violation of fundamental rights such as equality, privacy, correct process and freedom of expression. In this scenario, the Law needs to respond to the new challenges that arise and offer avant-garde legal responses. One of them is the recognition of human control as a new right to guarantee oversight in the design and development of these systems in order to avoid affecting other existing rights.La inteligencia artificial es uno de los mayores desarrollos tecnológicos del siglo XXI y tiene la capacidad para incidir de manera positiva, pero también negativa en la vida del ser humano. Así, el uso de sistemas de inteligencia artificial puede vulnerar derechos como la igualdad, la privacidad, el debido proceso y la libertad de expresión. En ese escenario, el derecho necesita responder a los nuevos retos que se plantean y ofrecer respuestas jurídicas vanguardistas. Una de ellas es el reconocimiento del control humano como un nuevo derecho para garantizar la veeduría humana en el diseño y desarrollo de dichos sistemas con el fin de evitar afectaciones a otros derechos ya existentes.
