The purpose of the mining easements constitution is to provide the legal title to access the surface land to the owner of a mining exploration concession or a mining exploitation concession. On the other hand, the exercise of the mining rights by the owner of the mining concession is limited by the requirement of obtaining, from the environmental administrative authority, the granting of the environmental qualification resolution. Such resolution, as well as the granting of the others environmental permits, are not a requirement to constitute the mining easements, but are administrative rules related to the public interest engaged in the environmental heritage conservation.La constitución de servidumbres mineras tiene por objeto otorgar al concesionario de exploración o explotación un título jurídico que lo habilite para acceder al predio superficial. Por otro lado, el ejercicio de los derechos mineros del concesionario se encuentra sujeto a ciertas limitaciones, en cuanto a obtener por parte de la autoridad administrativa ambiental, el otorgamiento de la respectiva resolución de calificación ambiental. Tal resolución de calificación, así como el otorgamiento de otros permisos de carácter ambiental, no corresponden a un requisito para la constitución de servidumbres mineras, sino que son exigencias de orden administrativo en razón del interés público comprometido en la conservación del patrimonio ambiental.
