dc.descriptionThis work focuses on the institution of the miner's waters, deepening its normative and jurisprudential reconfiguration according to the most recent pronouncements of the Courts of Justice. In this way, an attempt is made to give account of the current problems of mining projects, both in their environmental assessment and in their execution, together with a proposal of the new role of the miner’s waters as a solution to them. Finally, within the framework of the reform of the Water Code, a series of proposals are formulated to the modifications in process.en-US
dc.descriptionEste trabajo centra su estudio en la institución de las aguas del minero, ahondando en su reconfiguración normativa y jurisprudencial de acuerdo a los más recientes pronunciamientos de los Tribunales de Justicia. De esta manera se busca dar cuenta de las problemáticas actuales de los proyectos mineros, tanto en su evaluación ambiental como en su ejecución, junto con una propuesta del nuevo rol de los derechos de aprovechamiento de aguas del minero como solución a estos. Finalmente en el marco de la reforma al Código de Aguas se formulan una serie de propuestas a las modificaciones en trámite.es-ES
