dc.descriptionThe objective of this study is to analyze the main setbacks introduced by the 2012 Brazilian Forestry Act and the political context of its formulation. The analysis is based on a comparison of the rules that regulate the Institutes of the Permanent Preservation Area (APP) and Legal Reserve Area (ARL) in private agrarian properties by the Forest Laws of 1965 and 2012. As well as the positions and interests of the most relevant ac-tors in relation to the protection of natural forests, highlighting the great influence of the agricultural sector. The study demonstrates that the 2012 Forestry Law was formulated to weaken the two main legal institutes for protecting native vegetation in private agrarian properties, legalizes illegal occupations of the two protected areas, amnesties the offenders and increases the territory susceptible of deforestation. In spite of the legislative alterations promoted by the Forest Act of 2012 characterize an indisputable violation to the constitutional guarantee of prohibition of environmental backsliding and of the duties of environmental protection of the Brazilian State, the Federal Supreme Court endorsed them, based on the principle of the division of powers.en-US
dc.descriptionEl objetivo de este estudio es analizar los principales retrocesos introducidos por la Ley Forestal de Brasil de 2012 y el contexto político de su formulación. El aná-lisis se basa en la comparación de las reglas que disciplinan los Institutos del Área de Preservación Permanente (APP) y del Área de Reserva Legal (ARL) en propiedades agrarias privadas por las Leyes Forestales de 1965 y 2012. Así como en las posiciones y los intere-ses de los actores más relevantes en relación con la protección de los bosques naturales, poniendo de relieve la gran influencia del sector agrario. El estudio demuestra que la Ley Forestal de 2012 fue formulada para anular casi completamente los dos principales Institu-tos Jurídicos de protección de la vegetación nativa en propiedades agrarias privadas, legali-zar las ocupaciones ilegales de los dos espacios protegidos, amnistiar a los infractores y aumentar el territorio susceptible de deforestación legal. A pesar de las alteraciones legislativas promovidas por la Ley Forestal de 2012 la indiscutible violación a la garantía constitucional de prohibición de retroceso ambiental y de los deberes de protección ambiental del Estado brasileño, el Supremo Tribunal Federal las refrendó, con base en el principio de la división de poderes.es-ES
