The following work attempts to identify the scope of the presumtion contained in article 52 of Law No. 19.300. The latter considers not only the legal structure of said presumption but also the interpretation that the legal scholars and the Environmental Courts jurisprudence has made regarding the aforementioned presumption.En el presente trabajo se busca identificar el alcance de la presunción contenida en el artículo 52 de la Ley N° 19.300, tanto desde su dimensión normativa, como de la interpretación que la doctrina y la jurisprudencia de los Tribunales Ambientales le han dado, así como también de las implicancias prácticas de la referida jurisprudencia.
