Ecuador has promoted important inputs to the discussion of XXI century Environmental Law, since the recognition of the Nature as a subject of rights, and for it proposes to protect the biodiversity. The Ecuadorian congressman has included in the national water law a new figure of water protection areas, a sui generis category, because it has similar conditions like a national park, and it accomplishes the conservation of fragile ecosystems which could guarantee the human right of water during drought especially due climate change effects. This paper study the constitution and secondary normative with an historical vision, especially focus in the evolution of environmental law, the work put emphasis on the success of the norm in relation to this new figure of protection and show the process with the purpose to make it exportable to other legislation. The figure of water protection areas shows how the combination of efforts between different actors: public, private and communitarian, could obtain positive results for the environment protection and as an action against climate change, as mitigation and adaptation measures. En materia de aguas, el legislador ecuatoriano incluye la protección de las fuentes de agua a través de las Áreas de Protección Hídrica, figura sui generis, pues compara su protección al de un parque nacional, y cumple con la conservación de ecosistemas frágiles que permiten garantizar el derecho humano al agua en épocas de escasez del recurso frente al cambio climático. Este artículo analiza la normativa constitucional y legal de manera histórica, teniendo en cuenta la evolución legal en materia ambiental, pone en evidencia los aciertos que tiene la norma en relación a esta figura de conservación y esquematiza su procedimiento con el propósito que sea extrapolable a otras legislaciones. La figura de las Áreas de Protección Hídrica muestra que la combinación de esfuerzos entre los diferentes sectores —público, privado y comunitario— tiene resultados positivos para la conservación del medio ambiente y como medida de mitigación y adaptación al cambio climático.
