dc.descriptionChile is Party to the Convention on Biological Diversity, whose third objective is the fair and equitable distribution of benefits derived from the use of genetic resources. However, to date we lack as a country a regulatory framework for access to genetic resources and benefit sharing, which means uncertainty for those who wish to do research and development from genetic resources of Chilean origin and a loss of opportunity for benefits that could derive from such use. Assuming that the Nagoya Protocol establishes a widely accepted standard on the subject, this paper examines its main obligations, and then revises what it would mean for Chile to satisfy that standard, in light of the regulations in force. From this, it concludes with some guidelines for an ABS regulation in Chile. dc.descriptionChile es parte del Convenio sobre la Diversidad Biológica, cuyo tercer objetivo es la distribución justa y equitativa de los beneficios que se deriven de la utilización de los recursos genéticos. No obstante, a la fecha carecemos como país de un marco regulatorio de acceso a recursos genéticos y distribución de beneficios, lo que significa incertidumbre para quienes desean hacer investigación y desarrollo a partir de recursos genéticos de origen chileno y una pérdida de oportunidad en los beneficios que pudiesen derivar de tal utilización. Asumiendo que el Protocolo de Nagoya establece un estándar ampliamente aceptado sobre la materia, el presente trabajo examina sus principales obligaciones, para luego revisar qué implicaría para Chile satisfacer ese estándar a la luz de las normas vigentes. A partir de ello, se concluye con algunos lineamientos para una regulación de sobre acceso y distribución de beneficios en Chile.es-ES
