dc.descriptionThe integrated management of natural resources: water-energy-food, must be a constant for more efficient use of resources, and this synergy is evident in the three elements of the Nexus Approach. These interconnections cannot be distanced from human rights, as they are the common thread for the fulfillment of the Sustainable Development Goals and the interactions that may arise between water-energy-food. This paper addressed the constitutional anchor to determine whether elements of the nexus approach are present. It concluded that, although the constituent assembly members of 2008 did not formulate the creation of the Constitution from the Nexus approach, the constitutional norm does develop elements such as economic sovereignty, of which food and energy sovereignty is part; in addition, the human right to water is established as an autonomous right and identifies the different uses of water avoiding a possible conflict over its use, clarifying which are the interactions of the water resource with sectors such as food and energy. This requires the mandatory application of the constitutional mandate, allowing the projection of its requirements on the entire Ecuadorian legal system, in order to make the Constitution a reality in its aspect of guaranteeing fundamental rights linked to the environment, as well as sustainable economic development, aligned with the fulfillment of the SDGs.en-US
dc.descriptionLa gestión integrada de los recursos naturales debe ser una constante para un uso más eficiente de los recursos, y esta sinergia se evidencia en los tres elementos del enfoque nexo agua-energía-alimento. Estas interconexiones no pueden alejarse de los derechos humanos, ya que son el hilo conductor del cumplimiento de los Objetivos de Desarrollo Sostenible (ODS) y de las interacciones que se puedan suscitar entre agua, energía y alimento. El presente trabajo aborda el anclaje constitucional para determinar si existen elementos del enfoque nexo. Concluye que, si bien los asambleístas constituyentes de 2008 no formularon la creación de la Constitución a partir del enfoque nexo, la norma constitucional sí desarrolla elementos como la soberanía económica, de la que forma parte la soberanía alimentaria y energética. Además, se establece el derecho humano al agua como un derecho autónomo e identifica los diferentes usos del agua evitando una posible conflictividad por el uso, esclareciendo cuáles son las interacciones del recurso hídrico con sectores como la alimentación y energía. Esto exige la aplicación obligatoria del mandato constitucional, lo que permite proyectar sus exigencias sobre todo el ordenamiento jurídico ecuatoriano, en aras de hacer realidad la Constitución en su vertiente de garantía de los derechos fundamentales anudados al medio ambiente, así como a un desarrollo económico sustentable alineado al cumplimiento de los ODS.es-ES
