| dc.description | This paper analyzes the legal framework for the protection of plant varieties in Chile. Specifically, the protection mechanisms contemplated in the legislation of that country are reviewed in favor of the breeder of a plant variety, focusing on the absence of special civil actions, and the effects that this has had.
From a methodological perspective, the study is done through the comparative analysis of other laws that do contemplate special civil actions, in orden to maje proposals for their integration into the national legal system. | en-US |
| dc.description | En el presente trabajo se revisa el estatuto jurídico de protección de las obtenciones vegetales en Chile. En concreto, se analizan los mecanismos de protección contemplados en la legislación nacional, en favor del obtentor de una variedad vegetal, centrándonos en la ausencia de acciones civiles especiales, y los efectos que ello ha tenido.
Desde una perspectiva metodológica, el estudio se hace a través del análisis comparado de otras legislaciones que sí contemplan acciones especiales de naturaleza civil, a fin de realizar propuestas para su integración en el ordenamiento jurídico nacional. | es-ES |
