dc.description	The paper aims to justify the negation of the construction of indirect perpetration by organization control, because its elements are problematic and contradictory with principles of the participation theory. Especially the fungibility of the executants establish an alien feature in regard to the criminal imputation of the direct perpetrator, who acts in a completely responsible way. That leads to exclude the authorship of the hierarchical superior who gave the criminal order and affirm his responsibility as instigator.	en-US
dc.description	El artículo pretende justificar la negación de la figura de la autoría mediata por dominio de la organización debido a que sus presupuestos son problemáticos y contradictorios con máximas de la teoría de la intervención delictiva. En especial, la fungibilidad de los ejecutores constituye una característica ajena a la imputación jurídico penal del autor directo, quien actúa de forma completamente responsable. Ello lleva a excluir la autoría del superior jerárquico que imparte la orden criminal y afirmar su responsabilidad como inductor.	es-ES
