dc.descriptionIt’s not novel to state that behind the apparent neutrality of criminal laws, there is a male perspective of law itself, one that does not consider the perspective of women within norms operation. One of the expressions of such a problem takes place in those situations in which a woman ends up injuring or killing her current or former partner at a time when the attack itself has momentarily ceased but within a history of permanent gender abuse and violence. Indeed, this situation raises a series of questions regarding the justification or exoneration of such conduct. Based on a recent Antofagasta’s court ruling, the idea of this article is to find a comparative analysis of the arguments that are used either to accept or reject a self-defense in these cases. With this purpose, the following piece seeks to analyze the traditional interpretation of the self-defense requirements and compare it with a gender perspective interpretation of them, endeavoring to reveal the particularities of cases of incessant gender violence that require a diverse interpretation of those requirements. Additionally, the article seeks to analyze the jurisprudential criteria regarding the relevance of the victim’s statement in such cases.en-US
dc.descriptionNo es novedad que tras la aparente neutralidad de las normas penales subyace una visión masculina del derecho, que no considera la perspectiva de las mujeres dentro de la operatividad de las normas. Una de las manifestaciones de esta problemática se da en aquellas situaciones en que una mujer termina lesionando o matando a quien es o fue su pareja, en momentos en que el ataque mismo ha cesado momentáneamente, pero en el marco de un historial de abusos y violencia de género. Dicha situación levanta un conjunto de interrogantes respecto a la justificación o exculpación de dicha conducta. A partir de una reciente sentencia de la Corte de Apelaciones de Antofagasta, la idea de este artículo es dar con un análisis comparativo de los argumentos para acoger o rechazar una legítima defensa en estos casos. Para ello, el texto busca analizar la interpretación tradicional de los requisitos de la legítima defensa, y compararla con una interpretación con perspectiva de género de estos, intentando relevar las particularidades de los casos de violencia de género permanente que mandatan a efectuar una interpretación diversa de dichos requisitos. Junto con ello, el artículo busca analizar los criterios jurisprudenciales respecto a la relevancia de la declaración de la víctima en estas causas.es-ES
