The enforcement of the constitutional state of exception decreed due to the pandemic caused by the Covid-19 virus, generated an arduous discussion during 2020 and 2021 regarding the legal nature of article 318 of the Penal Code. This paper tries to present the different positions held, through the review of an extensive number of rulings of the different courts of Appeals of the country in that period of time; as well as the position adopted by the Supreme Court and the effect this had on the higher courts. All of this, in order to pose a critical stance focused on restricting the scope of application of this provision.La entrada en vigencia del estado de excepción constitucional decretado con motivo de la pandemia provocada por el virus del Covid-19, generó una ardua discusión durante 2020 y 2021 respecto a la naturaleza jurídica del artículo 318 del Código Penal. Este trabajo intenta presentar las distintas posiciones sostenidas, mediante la revisión de un extenso número de fallos de las distintas cortes de Apelaciones del país en ese período de tiempo; así como de la postura que adoptó la Corte Suprema y el efecto que provocó esto en los tribunales superiores. Todo aquello, con el objeto de plantear una postura crítica enfocada en restringir el ámbito de aplicación de esta disposición.
