This paper addresses the main elements that make up the statute of the public telecommunications service concessionaire, in order to highlight some debates that stress the Chilean regulation on the matter. A brief review is given on the regulatory framework that presides over the installation, operation and exploitation of a telephone and data transmission service, as well as the institutional framework that acts as a counterpart. Likewise, the modalities that the granting of this type of concessions may adopt are specified, the requirements that the operator must meet, the reasons for their termination, as well as the main rights and obligations incumbent on the concessionaire. Based on some approaches formulated by the political-legislative discussion and by academic reflection, the author makes a critical balance regarding the current design of regulatory policy in this important sector of the Chilean economy.El presente trabajo aborda los principales elementos que configuran el régimen concesional de los servicios públicos de telecomunicaciones, con la finalidad de poner de relieve algunos debates que tensionan la regulación chilena sobre la materia. Se entrega un breve repaso sobre el marco normativo que preside la instalación, operación y explotación de un servicio de telefonía, transmisión de datos y acceso a Internet, así como la arquitectura institucional responsable. Asimismo, se precisan las modalidades que puede adoptar el otorgamiento de este tipo de concesiones, los requisitos que debe cumplir el operador, las causales de extinción del título habilitante, así como los principales derechos y obligaciones que incumben al concesionario. A partir de algunos planteamientos formulados por los entornos académico, político-legislativo y judicial, se efectúa un balance crítico respecto al diseño actual de la política regulatoria en este sector de la economía chilena.
