dc.descriptionThis text seeks to present to the reader, in a simplified manner, the main modifications provided by the Colombian transition system proposed in the peace agreement concluded between the Government and the FARC guerrilla. The peace agreement is complex and innovative, but its content has produced multiple misunderstandings and misinformation. One of the points of debate and confusion refers to the mechanisms of transitional justice and their implications. This text seeks to make accessible to a broad public (even not aware of the Colombian case) certain essential aspects agreed around the transitional justice system and to detect some of the legal challengeson what was agreed between the parties. Particularly, it will focus on the criminal benefits granted by the agreement and the perspective of restorative justice that inspires it.en-US
dc.descriptionEste texto busca presentar, de manera simplificada, las modificaciones principales que brinda el sistema de transición colombiano propuesto en el acuerdo de paz celebrado entre el Gobierno y la guerrilla de las FARC. El acuerdo de paz es complejo e innovador, y su contenido ha producido múltiples reacciones contrarias, incluyendo malentendidos y desinformaciones. Uno de los aspectos que mayor debate y confusión ha producido se refiere a los mecanismos de justicia transicional y sus implicaciones. Este texto busca hacer accesible a un público amplio —incluso no conocedor del caso colombiano— ciertos aspectos esenciales acordados alrededor del sistema de justicia transicional y detectar algunos de los desafíos legales sobre lo que fue acordado entre las partes. En particular, se centrará en los beneficios penales que otorga el acuerdo y la perspectiva de justicia restaurativa que lo inspira.es-ES
