Starting from the premise that the protection granted to women against sexual violence may vary according to the timing of the attack, the international systems for the protection of human rights specifically applicable to the matter are examined, with special reference to the system of the United Nations and the Inter-American System that are effective in periods of peace, as well as the system that is applied in times of armed conflict, focusing on the International Criminal Court and the relevant Statute. The study is based on the theory of legalization, as set out in the work Legalization and World Politics, which establishes the requirements that institutions must meet to determine their degree of development.Partiendo de la premisa de que la protección otorgada a la mujer contra la violencia sexual puede variar según la oportunidad en que se produce el atentado, se examinan los sistemas internacionales de protección de los derechos humanos aplicables específicamente a la materia, con especial referencia al sistema de las Naciones Unidas y al Sistema Interamericano que se hacen efectivos en períodos de paz, así como al sistema que se aplica en épocas de conflicto armado, centrándose este en la Corte Penal Internacional y al Estatuto pertinente. El estudio se basa en la teoría de la legalización, según se expone en la obra Legalization and World Politics, que establece los requisitos que debe reunir la institucionalidad para determinar su grado de desarrollo.
