The European Constitution is a very current issue, because the different member states of the European Union are currently in the process of ratifying said text and because of the special emphasis that the press has placed on a possible negative result of the referendum in France, founding people and, until now, promoter of European integration. This article analyzes the constitutional process, the reasons why it took place in those precise moments, the political motivations, its influential figures, its historical ambitions and its final result. Likewise, it is asked whether the Constitutional Convention, chaired by Giscard d'Estaing, has effectively fulfilled its established aims and objectives, endowing the EU with this Draft Treaty establishing a Constitution for Europe with powers and procedures to work effectively in an enlarged Union.La Constitución Europea es un tema muy actual, debido a que los diferentes Estados miembros de la Unión Europea se encuentran al presente en el proceso de ratificar dicho texto y por el especial énfasis que la prensa ha puesto en un posible resultado negativo del referéndum en Francia, pueblo fundador y, hasta ahora, impulsor de la integración europea. Este artículo analiza el proceso constitucional, las razones por las cuales tuvo lugar en aquellos precisos momentos, las motivaciones políticas, sus personajes influyentes, sus ambiciones históricas y su resultado final. Asimismo, se plantea si la Convención Constitucional, presidida por Giscard d'Estaing, efectivamente ha cumplido con sus fines y objetivos establecidos, dotando a la UE con este Proyecto de Tratado por el que se instituye una Constitución para Europa de facultades y procedimientos para trabajar eficazmente en una Unión ampliada.
