The Spratly Islands, located in the South China Sea, lie in a strategic zone adjacent to important commercial sea lanes and in an area possibly rich in hydrocarbon resources. Six States claim territorial sovereignty over the maritime features and therefore sovereign rights and jurisdiction over the sorrounding waters. China, the main actor in the region, claims all the features in the South China Sea. Under this context, we try to answer if the purpoted China’s hegemony is in fact legal in regard to the sovereignty over the Spratly Islands. In doing so, we introduce the historical background, whose economic, historic, legal and political elements explain the current status of the dispute.Las islas Spratly, en el Mar del Sur de China, se encuentran en una zona estratégica adyacente a importantes vías marítimas y en un área posiblemente rica en recursos hidrocarburos. Seis Estados reclaman tener soberanía territorial sobre las configuraciones marítimas y, por lo tanto, derechos de soberanía y jurisdicción sobre las aguas circundantes. El actor principal en la región, China, reclama la totalidad de las configuraciones en el Mar del Sur de China. Bajo este contexto intentamos dilucidar si la pretendida hegemonía China es jurídicamente válida respecto de la soberanía sobre las islas Spratly. Para esto se presentan los antecedentes históricos, cuyos componentes económicos, históricos, jurídicos y políticos explican el estado actual de la controversia.
