| dc.description | A central issue in any democratic society is deciding who can regulate the rights and duties of people. To resolve this, the Republic entrusted the exercise of sovereignty to elected authorities for determined periods and subordinated their actions to the Constitution, with the Legislative Power being essentially the body of democratic representation and the law, the norm with the highest level of legitimacy, since All the political forces represented in the National Congress work with transparency in its elaboration. This is not the case, however, of the decrees and regulations issued by the President of the Republic, which express only the opinion of a single-person body, without its pre-normative phase being sufficiently regulated to guarantee transparency and participation. | en-US |
| dc.description | Un tema central en toda sociedad democrática es decidir quién puede regular los derechos y deberes de las personas. Para resolver ello, la República confió el ejercicio de la soberanía a autoridades electas por plazos determinados y subordinó su actuar a la Constitución, siendo el Poder Legislativo por esencia el órgano de representación democrático y la ley, la norma con mayor nivel de legitimidad, pues en su elaboración trabajan con transparencia todas las fuerzas políticas representadas en el Congreso Nacional. No es este el caso, sin embargo, de los decretos y reglamentos emanados del Presidente de la República, que expresan sólo la opinión de un órgano unipersonal, sin que esté su fase prenormativa suficientemente regulada como para garantizar transparencia y participación. | es-ES |
