| dc.description | The present work deals with the attribution conferred to the Constitutional Court by article 93 No 16 of the Constitution, in order to resolve on the constitutionality of the supreme decrees. In summary, it sets out the background of said constitutional precept, the requirements of origin of the request consulted by him and the effects of the favorable sentence. Likewise, it specifies, in light of the jurisprudence of the Constitutional Court, the characteristics of the supreme decrees, the role of the regulations and the opportunity for the dictation of those. It then treats, in the same way, the problems in relation to which, although at the beginning there was an original discussion, this was overcome: maximum legal domain and legitimacy of the regulation to regulate, as well as those in which the discussion has recovered "supremes decrees" and the determination as to whether the Constitutional Court, in accordance with the provisions of article 93 No. 16, can implicitly prosecute the law. Next, it exposes the different tests that said Judiciary has used to evaluate when a regulation can address a certain regulation without violating the Constitution. Finally, it exposes the procedure consulted by the Organic Law of the Court in relation to the challenge of the supreme decrees. | en-US |
| dc.description | El presente trabajo trata sobre la atribución conferida al Tribunal Constitucional por el artículo 93 No 16 de la Constitución, en orden a resolver sobre la constitucionalidad de los decretos supremos. En síntesis, expone los antecedentes de dicho precepto constitucional, los requisitos de procedencia del requerimiento por él consultado y los efectos de la sentencia favorable. Asimismo, precisa, a la luz de la jurisprudencia del Tribunal Constitucional, las características de los decretos supremos, el rol de los reglamentos y la oportunidad para la dictación de aquellos. Luego trata, de la misma forma, los problemas en relación a los cuales si bien en un comienzo hubo discusión original, esta fue superada: dominio máximo legal y legitimidad del reglamento para regular, así como aquellos en los que la discusión ha recobrado "decretos supremos"; y la determinación en cuanto a si el Tribunal Constitucional, en conformidad a lo dispuesto en el artículo 93 No 16, puede enjuiciar implícitamente a la ley. A continuación, expone los diferentes test que dicha Magistratura ha utilizado para evaluar cuándo un reglamento puede abordar una determinada regulación sin violar la Constitución. Finalmente, expone el procedimiento consultado por la Ley Orgánica del Tribunal en relación a la impugnación de los decretos supremos. | es-ES |
