From the second half of the s. XX and mainly, based on the horrors that the world witnessed in World War II, a strong current of constitutionalism develops in Europe, manifested, among other aspects, in a special concern for guaranteeing fundamental rights. This line of thought has been called the democratic constitutional model or neo-constitutionalism. Starting the s. XXI it seems relevant to us to study the scope of the debate that has been developed in these matters in such a way that these contributions can serve the Chilean constitutionalism to take on the challenge of adapting the constitutional protection of fundamental rights.A partir de la segunda mitad del s. XX y principalmente, con base en los horrores de que fuera testigo el mundo en la II Guerra Mundial, se desarrolla en Europa una corriente de constitucionalismo fuerte, manifestada, entre otros aspectos, en una especial preocupación por garantizar los derechos fundamentales. Esta línea de pensamiento ha sido denominadDa modelo constitucional democrático o neoconstitucionalismo. Iniciando el s. XXI nos parece relevante estudiar los alcances del debate que se ha desarrollado en estas materias de forma tal que estos aportes puedan servir al constitucionalismo chileno para asumir el desafío de adecuar la protección constitucional de los derechos fundamentales.
