| dc.description | When studying several jurisprudential cases on RPA with similar or identical factual circumstances, or the evolution of the same cause in the different procedural instances, we verify that the sentences resolve in a different way and even on many occasions in an absolutely contradictory way, and when they do not differ in the resolution, the grounds to which they resort are substantially different, and to that extent difficult to formalize in arguments of legal technique. This "jurisprudential anarchy" reaches such a level that not even the CS, court of cassation, and to that extent called to unify the different jurisprudential criteria of the lower courts, has and maintains its own jurisprudential criteria in this matter. | en-US |
| dc.description | Al estudiar varios casos jurisprudenciales sobre RPA con circunstancias fácticas parecidas o idénticas, o la evolución de una misma causa en las distintas instancias procesales, constatamos que las sentencias resuelven de manera diversa e incluso en no pocas ocasiones de forma absolutamente contradictoria, y cuando no difieren en lo resolutivo, los fundamentos a los que recurren son sustancialmente distintos, y en esa medida difícilmente formalizable en argumentos de técnica jurídica. A tal nivel llega esta "anarquía jurisprudencial" que ni siquiera la CS, corte de casación, y en esa medida llamada a unificar los distintos criterios jurisprudenciales de los tribunales inferiores,tiene y mantiene en esta materia un criterio jurisprudencial propio | es-ES |
