Abstract
In this article the author analyzes the constitutional and legal rules that circumscribe the powers of the Public Prosecutor and the Internal Revenue Service to prosecute tax crimes. To do so, it undertakes a legal and historical reconstruction of the modifications and adequation laws of the new criminal procedure system, then develop the presuppositions of the thesis of the article: the tacit revocation of the exclusive power of the Director
of the Service to autonomously decide the start of a criminal investigation for a possible tax crime, once dictated the constitutional reform that created the Public Prosecutor and the nature of public prosecution of the tax crime. En el presente artículo el autor analiza las normas constitucionales y reglas legales que circunscriben las atribuciones del Ministerio Público y el Servicio de Impuesto Internos para la persecución de delitos tributarios. Para ello, emprende una reconstrucción histórico – jurídica de las modificaciones y leyes adecuatorias del nuevo sistema procesal penal para luego desarrollar los presupuestos de las tesis del artículo: la derogación tácita de la facultad exclusiva del Director del SII para decidir en forma autónoma el inicio de una
investigación penal por un posible delito tributario, dictada la reforma constitucional que creo el Ministerio Público y la naturaleza de delito de acción penal público del delito tributario.
