Subsequent to the presentation of the Report of the National Commission on Political Prison and Torture, Law No. 19.992, through article 15, established the secrecy of the documents, testimony and background provided by the victims before the Commission, which will be maintained for the term of 50 years. In the pages that follow we will examine this secret, and the way in which it constitutes an obstacle to the achievement of truth and justice by the serious violations of human rights that have occurred in Chile. We will end by reflecting on some ways to deal with this rule, in order to allow the investigation, prosecution and punishment of these crimes.Con posterioridad a la presentación del Informe de la Comisión Nacional de Prisión Política y Tortura, la Ley 19.992, mediante su artículo 15, estableció el secreto de los documentos, testimonios y antecedentes aportados por las víctimas ante la Comisión, el cual se mantendrá durante el plazo de 50 años. En las páginas que sigue examinaremos dicho secreto, y la forma en que constituye un obstáculo a la consecución de verdad y justicia por las graves violaciones a los derechos humanos ocurridas en Chile. Terminaremos reflexionando sobre algunas vías para hacer frente a dicha norma, para efectos de permitir la investigación, enjuiciamiento y el castigo de estos crímenes.
