During the year 2018, the Supreme Court consolidated an important change in the jurisprudence of high-cost medication when the life of a patient is at risk. With the right to life as the starting point, it’s upheld that the patients have the right to receive the medication they need to survive at that moment, no matter the cost. This work aims to analyze Supreme Court jurisprudence changes and their consequences in the structure of the protection remedy of constitutional rights.Durante 2018, la Corte Suprema consolidó un importante cambio en su jurisprudencia sobre medicamentos de alto costo cuando se encuentra en riesgo la vida de un paciente. A partir del derecho a la vida, se sostiene que los pacientes tienen derecho a recibir aquellos medicamentos que requieren para sobrevivir en lo inmediato sin importar su costo. El objetivo de este trabajo es analizar este cambio jurisprudencial y sus consecuencias con respecto a la estructura de la acción de protección.
