dc.descriptionThe standard of duty of care applicable to the State’s liability for acts of Gendarmería de Chile (Chilean Prison Service) in the jurisprudence of the Supreme Court has not been subject of study to date. The present investigation reviews the decisions of the Supreme Court issued in this matter during the last ten years. For this purpose, the Supreme Court decisions will be classified in accordance to the party that has been subject to damage due to acts of Gendarmeria de Chile. This analysis will consider a fundamental tension in State liability: the contest between general and specific duties of care.en-US
dc.descriptionEl estándar de cuidado aplicable a la responsabilidad del Estado en las actuaciones de Gendarmería de Chile, en la jurisprudencia de la Corte Suprema, no ha sido objeto de estudio detallado a la fecha. En el presente trabajo se revisará la jurisprudencia del máximo tribunal dictada en esta materia durante los últimos diez años. Para ello se clasificarán las sentencias según el sujeto que ha padecido el daño por el actuar de Gendarmería de Chile. Este análisis será realizado bajo la óptica de una tensión fundamental en la responsabilidad del Estado por falta de servicio: la pugna entre deberes generales y deberes concretos de responsabilidad.es-ES
