The author, after an explanation of the first intents of codification occurred in Peru, in which he emphatizes the personality of Manuel Vidaurre, deals with the civil code of 1852, in which he observes a resistance to the change and a persitence of traditional elements such as property, slavery, marriage, divorce and the clerymen status. Then an outline is produced of the diffusion and importance of the Code Napoleon in Peru, comparting its dispositions to those of the peruvian Code, although by the fact of not being clear and determined the modernizing project, a pretty amount of defiance was born in the own sectors that lead its establishment.El autor, tras referirse a los primeros intentos de codificación de hubo en el Perú, en que destaca la figura de Manuel Vidaurre, pasa a referirse al Código Civil de 1852, en que observa una resistencia al cambio y persistencia de elementos tradicionales en materia de propiedad, esclavitud, matrimonio, divorcio y tratamientos de los clérigos. Luego pasa a referirse a la difusión e importancia del Código de Napoleón en el Perú, comparando sus disposiciones con las del referido Código, aunque por no ser el proyecto modernizador claro y decidido, despertó una gran cantidad de recelos en los propios sectores líderes.
