Abstract
The rise of the modern State did not just mean the instauration of a political and cultural system capable of articulate the ideas of reason, private property and liberty, but also implied a Copemican twist in the law and its application. Such changes were even more pronunciated in Hispanic America, in which countries imperated a casuistic system of law, established in the judicial arbitrarnent, characteristics that later were replaced by the concept of system and legal application of the rule. Thus, the present study intends to demonstrate the tensions and frictions that were present in the transition from the Spanish Colonial Law to the codificated law in Peru. El surgimiento del Estado moderno no sólo significo la instauración de un sistema político y cultural capaz de articular las ideas de razón, propiedad privada y libertad, sino que también implico un giro copernicano en el derecho y su aplicación. Dichos cambios fueron aún más pronunciados en Hispanoamérica, en cuyos países imperaba un sistema de derecho casuista y asentado en el arbitrio judicial, notas que luego fueron reemplazadas por el concepto de sistema y aplicación legalista de la norma. De ahí que, el presente estudio procure develar las tensiones y fricciones que se presentaron en el tránsito del sistema de derecho indiano al derecho codificado en el Perú.
